A man allegedly bashed by bikie boss Toby Mitchell has fled the country to avoid being questioned by police.

Anthony Hess, 39, jumped on a flight to Los Angeles on Wednesday after the Mongols president was arrested the day before.

He did not make a police statement about the October 4 incident and told Daily Mail Australia he wants the charges against Mitchell dropped.

The pair, who have been close friends for eight years, were drinking outside Gilson cafe in South Yarra with other Mongols including top lieutenant Mark Balsillie.

‘We were all drinking and having a good time, everyone was in good spirits and enjoying the restrictions lifting and the nice weather,’ Hess said.

The socialite said after Mitchell allegedly hit him from behind he ran out the back door of the cafe onto the road, tripped and fell on to a car.

‘The driver drove me to the hospital, even though I insisted I was okay,’ he said.

Hess said he chalked the incident up to a drunken ‘misunderstanding’ between mates on ‘another wild night’ and thought nothing more of it.

‘I was just a drunk hot mess and things had become a bit crazy but I didn’t except the police to be involved and Toby to be charged,’ he said.

‘I asked the police not to charge Toby as we were both drunk and the situation escalated.

‘The police have completely blown this out of proportion. They should just drop the charges as I never wanted him arrested.’

Hess was spotted at the Ritz Carlton hotel in downtown Los Angeles on Thursday with former Neighbours star Scarlet Vas and socialite Stephanie Mal.

Hess, who was given special permission to leave Australia despite the travel ban, said he was staying in the U.S. for some time to ‘let the whole thing blow over’. 

Mitchell faces charges of affray, intentionally causing injury and two counts of assault, which he will contest on March 12.

The veteran bikie was banned from associating with his fellow Mongols or going within 150m of the cafe as a condition of his bail.

Detective senior constable Lauren Kane claimed Hess had refused to make a statement because he was ‘in fear for his life’.

Police instead seized his medical records, which indicated he was treated for a suspected facial fracture at The Alfred Hospital.

‘The accused assaulted a person multiple times in what appears to be an unprovoked attack,’ she said.

DSC Kane asked Melbourne Magistrates Court to deny Mitchell bail because there was an ‘unacceptable risk’ he would try to intimidate witnesses.

She alleged 10 to 15 Mongols members gathered outside the cafe a week after the incident in an ‘obvious show of strength’.

Mitchell called DSC Kane asking why police were investigating the incident after she left her business card at the cafe, the court heard.

Mitchell’s lawyer Damian Sheales accused police of grandstanding over ‘the most minor incident in the world’.

‘What Mr Mitchell does is slap [the victim] with an open hand three times and the fellow doesn’t even lose his drink,’ he said.

Mr Sheales said he was ‘mystified’ why police arrested the tattooed enforcer and hauled him before court instead of just giving him a summons.

‘It’s got the smack of grandstanding about it,’ he said. 

Mitchell, who often taunts police and shows off his flashy lifestyle on social media, celebrated his release on Instagram within hours.

‘Who said you can’t get in trouble during COVID,’ he wrote. 

He then shared a video of the view from his South Melbourne flat with the caption ‘from a jail cell to a dream in a day’.

Homeowners and renters living in New South Wales are being hit with wildly different council tax rates, with immediate neighbours paying up to $539 less than one another.  

Residents who live in the Wollondilly Shire Council, a huge region which encompasses Macarthur, Blue Mountains, the Central Tablelands and Greater Western Sydney, were slugged an eye-watering $1,810.29 annually.

Those from Blue Mountains Council coughed up $1,747.22 and Hunters Hill Council residents paid $1,736.25, according to statistics from NSW Council’s Average Annual Residential Rate.

Despite being around 50km from Sydney’s CBD, the areas are hit with significantly higher council tax rates than those living in the city’s affluent North Shore.

CHEAPEST COUNCIL TAX RATES IN NSW 

1. City of Sydney – $708.40

2. North Sydney – $747.87

3. Strathfield – $785.13

4. Fairfield – $788.17

5. Canada Bay – $931.11

6. Parramatta (new) – $950.54

7. Cumberland – $961.68

8. Blacktown – $1016.03

9. Bayside – $1017.52

10. Willoughby –  $1033.28

Surprisingly, it was a very different story for ratepayers from Strathfield Council, where rates are just $785.13 and in North Sydney Council, where residents pay $747.87.

The cost for those living within the City of Sydney Council is $708.40.

Many would consider these three areas among the richest areas of Sydney, with house prices comfortably fetching more than $1million.

Those living in Camden Council, in south-west Sydney, forked out a staggering $539 less in rates than Wollondilly Shire Council home owners – which is just one street over.

Camden ratepayer and father of three Charles Ganer lives on the border between both council areas.

He acknowledged his personal circumstances were favourable compared to some of his neighbours.

‘The council (Camden) does a good job and I know people over the border in Wollondilly pay a lot more and consequently I think we get good value in comparison,’ he told the Daily Telegraph.

‘I am happy to pay rates if I feel the council is providing me with services. They certainly keep the area clean.’

Fairfield ratepayers also pay relatively low council rates at $788.17, with local Mayor Frank Carbone stating ‘every dollar spent is for the community.’

Local Government Minister Shelley Hancock said if people feel their specific council rates are too high, it is best to contact relevant local councillors who can reveal what services have been introduced for community enhancement.

A streets preacher from Tennessee is suing a school district that allegedly kicked out his 15-year-old daughter after wearing a shirt that read ‘Homosexuality is a sin.’ 

Richard Penkoski says Overton County Schools violated his daughter’s rights to free speech after being kicked out of the class specifically because of the shirt she was wearing at Livingston Academy in August. 

It read: ‘Homosexuality is a sin – 1 Corinthians 6:9-10,’ referring to first Corinthians chapter six in the Bible.

Penkoski’s daughter was sent to the principal’s office where the teenager was told the shirt broke the school’s dress code for being ‘sexually connotative.’   

The girl protested her case noting that a ‘pro-homosexual symbol’ was on display inside the classroom referring to a rainbow flag used by the LGBTQ community according to the lawsuit seen by the New York Post and filed in the US District Court for the Middle District of Tennessee last week. 

Penkoski runs a ministry called Warriors for Christ and filed the lawsuit earlier this month. 

His daughter, who is identified in the lawsuit as ‘B.A.P.’, explained to administrators that she was unable to cover up her top and ended up texting her parents about the issue.

The lawsuit states that the the 15-year-old was forced to choose between ‘abandoning her religious beliefs’ or ‘following her personal convictions’ only to be disciplined. She claims that receiving a punishment imposed a ‘substantial burden’ on her.

Penkoski posted a photo of his daughter wearing the shirt one day after the incident.

‘My 15 year old was thrown out of school for the day for wearing this shirt,’ he said in a tweet on August 26. ‘#lgbt wants to trample on your #freespeech rights while they cry for special rights.’

‘There are some educated people who support the lgbt!! While some don’t agree with the shirt my daughter wore they understand she has a constitutional right to wear it,’ he later said in a tweet on September 19. ‘Her rights don’t end where your feelings begin.’ 

The lawsuit claims the teenager’s  First and Fourteenth Amendment rights to free speech and freedom of religion were violated. The suit states that the incident also violated protections granted by Tennessee’s Religious Freedom Restoration Act, according to the Charlotte Observer.
